Malu pouches have a Limited 1 Year Warranty
Malu Limited Warranty for Malu watersport accessories is a commercial manufacturer’s warranty provided by Mike and Co (PTY) Ltd. (“Malu”) and is applicable in South Africa. Rights attached to this warranty are distinct to the rights provided by applicable consumer law and this warranty shall be construed as in addition to, and not instead of, rights granted by applicable consumer law. Malu Limited Warranty for Malu watersport accessories (the “Warranty”) is valid only in the countries where Malu watersport accessories are sold by retailers listed on Malu’s website.
What is covered?
This Warranty covers any Malu branded accessory (“Product”), available through the retailers listed on the Malu website, against defects in materials or workmanship, when used fully in accordance with Malu “Using you Malu” guidelines attached to each Product.
What is not covered?
This Warranty does not cover:
Natural wear and tear;
Cosmetic damage, including scratches;
Damage to car keys or other valuables;
Damage caused by sharp objects, such as keys;
Malu is not responsible for damage arising from failure to follow instructions “Using your Malu” relating to the Product’s use.
How long does the coverage last?
Malu Limited Warranty for Malu watersport accessories runs for ONE (1) YEAR from the date you initially purchased the Product.
How to get Service?
You may contact our customer support department by email, email@example.com, explaining the issue and attaching your proof of purchase.
What will Malu do?
If your Product is covered by Malu Limited Warranty for Malu watersport accessories, we will provide you with a free replacement Product and we will bear the cost of (1) returning the Product and (2) shipping of the replacement Product. The replacement Product will be sent to you after reception of the Product under warranty. The replacement Product is warranted for the remainder of the original Product’s warranty period or for an additional 90 days starting from the Delivery date of the replacement Product, whichever is longer. However, in the case that we or our subcontractors conclude, after checking the returned Product that the warranty provided under these terms does not apply due to any exclusion provision, we may nevertheless be able to provide you with the following choice:
We send a Product back to you at your own expense and risk after payment of all return shipping and handling expenses.
Destruction of the Product. This solution will be automatically chosen if you refuse to pay the returning expenses within 14 days from the day we notified you of the fact that the Product is not covered by Malu Limited Warranty for Malu watersport accessories.
Limitation of liability
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, MALU IS NOT LIABLE FOR ANY DIRECT, INDIRECT (SUCH AS LOSS OF USE, LOSS OF REVENUE, LOSS OF OPPORTUNITY, LOSS OF REPUTATION), SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF MALU LIMITED WARRANTY FOR MALU WATERSPORT ACCESSORIES OR FROM ANY MISUSE OF THE PRODUCT. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO PERSONAL INJURY, TO THE EXTENT SUCH LIMITATION IS NOT PERMITTED BY LAW.
